Waves is suing me
That's right - the studio got a letter from a law firm
representing Waves Audio Ltd., informing us of their
intention to pursue legal action as the result of
unliscensed software use, with statuatory damages in
the area of $150,000. The letter went on to suggest I
get in touch with the firm if I have an interest in
pursuing settlement discussions to avoid litigation,
and that I get a lawyer.
So I called up the law offices to find out what the
hell was going on and I was told that they have
evidence to prove unliscensed software is in use at
the studio. "How could you possibly have this
evidence?" I asked.
"A representative was at the facility."
"Who?"
"I can't tell you that."
"What's the evidence?"
"All I can tell you is that we have evidence."
"You can't tell me anything else?"
"I can tell you the date the evidence was collected."
So she gave me a date, and sure enough, on that day
some Israeli guy (Waves is based in Tel Aviv) came by
to check out the studio and, as my partner recalled,
he had lots of questions about whether we had Waves
software and whether we were using it. My partner
explained that we have a trial version for the time
being, and opened up a Pro Tools session to show him
(he wanted to see it).
This is totally ****ed up. They want to settle for
$30,000, which is about $28,000 beyond our means at
the moment. The phone conversation ended with me
asking, "What exactly are we supposed to do now?" Get
a lawyer. "Well, you know where to find me," I said.
I spoke to a lawyer friend today, which was slightly
reassuring, but he couldn't tell me much. Has this
happened to anyone else? An internet search turned up
lots of bitching about Waves, but nothing like this.
Is it illegal to use trial software for commercial
purposes? I thought that was the whole point. The
trial was on a CD that a friend gave me, so it wasn't
acquired directly from Waves. Our business is mostly
analog so plug-ins are not a big priority for us.
The ironic thing about all this is that we were
planning on buying the Diamond bundle as soon as
possible. We gross about $150,000 annually, so we're a
pretty small business. I can't believe they're going
after us, but they seem serious about it.
